In completing and submitting the Booking Form, you agree to be bound by these conditions which constitute the agreement between Himalayan Shepherd and you. These conditions apply to the exclusion of any other terms or conditions unless they are set out in the Booking Form or are otherwise agreed to in writing by the parties. Previous dealings between the parties will not vary these conditions. No purported variation of these conditions will be effective unless in writing and signed by a person so authorized by Himalayan Shepherd.

 

Himalayan Shepherd kindly requests our clients to apply the following  Terms and Conditions that will lead to further bonding between you (client) and Himalayan Shepherds Eco Trek and Expedition  Pvt. Ltd. (hereinafter referred to as “The Company”), Registered Company Number 248344/077/078. The terms and conditions bound you while booking and canceling the trip and certain limitations of liability. The Booking Terms and Conditions maintain your legal relationship with the company.

1. Advance Booking and Payment

If you intend to join a trip with Himalayan Shepherd, you are required to book two months before it. Two months of preparation time is necessary for the best service, safety, and satisfaction. 

30% as a booking - Advance payment has to be done as confirmation.

The remaining payment has to be done upon arrival in Kathmandu before the starting date of the Expedition.

We must assure you that if there will be any delay or loss during the transfer process we will not liable. If we receive less amount due to the use of a mediator bank or any other reason, you should pay the cost accordingly to cover the product cost.

2. Cancellation Policy

 a. Cancelled by the company

Himalayan Shepherd reserves the full authentic right to cancel any trip you booked until guaranteed to be run. Normally if the condition will be beyond our control i.e. due to natural disasters, flight cancellation, and consequences of strikes, industrial action, wars, riots, sickness, quarantine, government intervention, weather conditions, or other untoward occurrences we will cancel the trip. In these cases, we will refund the trip price. Sometimes the guaranteed departure may be canceled and at that time we will easily refund the trip deposit or we may give you an alternative trip having the same values. If any government permits, flight ticket, insurance has been issued and cannot be revoked and refunded you will be liable for these costs.

 

b. Cancelled by the client

We only accept the cancellation which is fully authentic and should be in written form and acknowledged by the Company. Regarding the charge of the cancellation, it will be determined according to the date of the cancellation request, which is received, by the Company.

In case of the advance payment and full payment, cancellation charges are as advised below: -

-60 days before departure: 10%

-30 days before departure: 25%

-15 days before departure: 50%

-2 to 3 days before departure: 75%

 

3. Late Booking

Last-minute booking can be done as early as one month before the departure from your country. But, it is to be noted that it might involve additional costs.

Booking done less than one month before the departure will have fewer chances of being approved and it will also require 50% to 100% advance payment.

 4. Amendment

Himalayan Shepherd respects the intention of the guests and provides alterations to the packages based on the client’s request provided that the client is willing to spend extra time and cost. At other times, because of the circumstances prevalent in the area, the standard cost and time may be subject to alterations. In that case, the price, program, and time can be adjusted by mutual agreement between the clients and the company.

5. Incomplete tour

In case the client drops out from the trip then no refund shall be made.

 6. Health and Fitness

To participate in our adventures like Trekking, Hiking, Mountaineering, etc. Good health and physical fitness are required. Before making any bookings for our trips, we request you to check with your doctors before you travel. If you have any existing medical condition or disability, you should inform us before booking. We have every right to refuse any person who is physically unfit for the trip. Otherwise, we may be able to design a custom adventure not detrimental to your health.

 7. Insurance

The Nepal Government Act 2053 does not allow the purchase of insurance in favor of foreign people. So clients must purchase a comprehensive travel insurance policy against medical, natural calamity, helicopter evacuation, personal accident, trip cancellation, theft and loss of personal baggage, etc. from their respective countries. Trekking and expedition may involve risks and several other factors that are unpredictable. So the company will be required to check your personal and insurance information. Also, the policies are needed to issue the permit.

8. Claims and complaints

We shall do our best to deliver the services as we promised/agreed during the trip booking. If you have a complaint about the trip please inform your tour leader or local representative at the time so that they can attempt to rectify the matter immediately. You can also report to our tour officer in Kathmandu. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour. If it's found that we failed to deliver the services promised we shall refund/compensate you the equivalent amount we fail to deliver.

9. Responsibility   

On most of our trips, we give full responsibility to our trip leaders or the trip guides. You will be bound to follow all the rules and regulations set by the company or the leaders chosen by the company. So if you commit any unlawful and unethical act, which is against the company's rules and regulations, you shall be compelled to leave the tour without any refunds.

10. Privacy

Privacy As part of the booking and permit process, we will need to obtain personal information from each client. Your personal will be securely kept by us and none of your private or personal information will be disclosed for any other purpose.

11. Publicity

We Himalayan Shepherd may require and request our clients to use the photographs and videos taken during the trip, without any fee or compensations for publicity and promotion. We do not sell or share your photos and videos with anyone. We assure you, it will only use for promotional purposes.

12. Children

All children below 18 are required to accompany by their legal guardian. For our expedition trip, they will only be allowed after the signing of the travel consent.

13. Additional Activities

For other extra activities other mention in itinerary or the program, for example, ski, paragliding, para skiing, documentary shooting, drone flying, waving large flags and so on., Clients should inform the company first and before the start of the trip. These extra activities will be charged and conducted as per the rules and regulations of the Nepal Government. If it is not informed beforehand, the company will not bear any responsibility. Yet if informed, the company will provide you with all the support and guidance.  

14. Accommodation

 As a hosting company, we try our best to provide the most comfortable and best deals. But despite all our best efforts, sometimes, we may not be able to provide guests with everything we promised for. In such instances, we expect guests to exhibit understanding and accommodate whatever is available.  Most importantly, it is important for guests to properly understand what they are getting into before they book the trip.

15. Meals

We have good cooks in our team. However, the food may not always be what you expect. We will have to cook you your meals with limited resources. We will make sure it is the best food provided. Clients have to make some compromises and choose from the limited menu available.

 16. Goods & Equipment's

All the goods and equipment provided to you should be returned to the company at the end of the trip. Any damages occur to the aforementioned equipment, the client has to pay the amount fixed by the agency as per compensation.

 Special requests: Please advise us of any special requests before making your booking. Where possible, we will endeavor to meet or arrange for our suppliers to meet any such request. Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. For your protection, you should obtain confirmation in writing that a special request will comply (where it is possible to give this) where it is important to you.

17. Visa and passport requirements

You should have your passport and a valid visa with at least 6 months validity in your passport. You will have an arrival Nepal visa in Nepal. Due to your incorrect visa documentation, if you will be rejected we will not be responsible for this. So if you will have any confusion regarding the visa application procedure please kindly inform us.

18. Regulatory Authority

This agreement and the rights and obligations of the parties shall be construed and take effect under the laws of Nepal and the Nepal Tourism Association.
